During a current "restructure" we all had to re- apply for what was essentially our old positions. Apart from the other affected employees, were 8 senior engineers (me being one of them). 8 corresponding positions were created in the new strucuture, with job descriptions very closely resembling our current respective job descriptions. Consequently, all of us applied for only the position "earmarked" for you. 7 of us got it, I was denied, with the company stating that they decided not to fill the position internally but rather to recruit externally, and that if and when a suitable candidate is found, I will essentially be demoted and have to report into him or her. I find this unfair, as during the past 4 years, in this very position, I have consistently overperformed to the degree of about 35 percent above my required deliverables. May the company discrimiate against me compared to the other 7 employees who have all had the opportunity to remain in (essentially) their current positions and can they deny me a position which essentially I am already performing (at a very high level of performance) in favour of an external candidiate. As reason, the company only stated that "they could not find any "suitable internal candidate"
