First the employer must show that there is a rule in the company that you were aware of relating to pornographic material. He must also prove that you accessed it personally as it could have been someone else with access to your logon or password He must also show what the misconduct precisely entails is - just having the porno is one thing and notm all people are offended, downloading it on company property thereby using company time and bandwith - he cannot be or act as your moral guardian but must have an employer interest in it in other words how it affects your work etc.
