I was employed with a Lawyer in 2008 April there was no contract signed his closed office in July 2009 with the explanation that he was in financial trouble, I was not registered nor was paye being deducted from my salary. In any event he suggested that I open my own business by working from home with one of the clients that we have dealt with for more than the year doing collections, he promised that he would take the risk and that any commission due to him on the collections will be paid directly to myself in the form of a cheque by the client. I have been in contact with the client on a daily basis and in October last year the client retracted the files and said that he would check the files and make payment. I was then told by the client that he will not deal with me as I was a third party. I have tried in vain to get payment made wich I think is only fair as I have done the work and have proof of all the debit orders etc, I have not been able to contact the attorney that I worked for as he will not answer his cell. Please advise if I can proceed with a complaint to the CCMA or what I should actually do, as I am job hunting the the recruiters are not able to contact him as he will not answer his phone.
