DOMESTIC WORKER MINIMUM WAGE - 2011

This year, the minimum wages for domestic workers who work 27 ordinary hours per week or less in Area A is R9.12 per hour, R246.30 per week and R1067.15 per month and for those in Area B it will be R7.60 per hour, R205.52 per week and R890.52 per month. "Those who work more than 27 ordinary hours per week the minimum wage will be R7.72 per hour, R347.79 per week and R1 506.35 per month or R6.44 per hour, R290.00 per week and R1 256.14 per month for Area B. The Department of Labour has warned that, as usual, there will be blitzes by labour inspectors. Those domestic employers who choose to ignore this determination can be forced to pay minimum wages and they can expect no mercy. Area A is all urban areas with Municipalities like Bergrivier, City of Tshwane, Nelson Mandela, Lesedi, Mosselbaai, Emfuleni, Polokwane, among others, whereas Area B is for all those municipalities not listed in Area A. Labour Inspectors do not have automatic access to private property but they can summons employers by issuing compliance orders to provide details of their employees. Ignoring these orders can result in a court order in labour court and these in turn can result in contempt of court charges and a fine, both by the Department of Labour and the Labour Court. Annual increases prescribed by law are based on current earnings and not the minimum wage.
